This service is used on the basis of your consent pursuant to Art. 6(1) 1 lit. (a) GDPR and Section 25(1) TDDDG. You can revoke your consent at any time. We use the Advanced Matching feature within the Meta Pixel. Advanced Matching enables us to transmit various types of data (e.g., place of residence, state, postal code, hashed email addresses, names, gender, date of birth, or phone number) of our customers and prospects that we collect via our website to Meta. This allows us to tailor our advertising campaigns on Facebook and Instagram even more precisely to people who are interested in our offers. In addition, Advanced Matching improves the attribution of website conversions and expands Custom Audiences. To the extent that personal data is collected on our website with the help of the tool described here and forwarded to Meta, we and Meta Platforms Ireland Limited, Merrion Road Dublin 4, Dublin, D04 X2K5, Ireland, are jointly responsible for this data processing (Art. 26 GDPR). The joint responsibility is limited exclusively to the collection of the data and its transfer to Meta. Processing by Meta after the transfer is not part of the joint responsibility.

The obligations we share have been set out in an agreement on joint processing. You can find the wording of the agreement at: https://www.facebook.com/legal/controller_addendum.

According to this agreement, we are responsible for providing the privacy information when using the Meta tool and for implementing the tool on our website in a data-protection-compliant manner. Meta is responsible for the security of Meta products.

You can assert data subject rights (e.g., requests for information) regarding the data processed on Facebook or Instagram directly with Meta. If you assert your data subject rights with us, we are obliged to forward them to Meta.

Data transfers to the USA are based on the EU Commission’s Standard Contractual Clauses. Details can be found here: https://www.facebook.com/legal/EU_data_transfer_addendum and https://de-de.facebook.com/help/566994660333381.

You can find further information on protecting your privacy in Meta’s privacy notices: https://de-de.facebook.com/about/privacy/.

You can also deactivate the remarketing function “Custom Audiences” in the ad settings area at https://www.facebook.com/ads/preferences/?entry_product=ad_settings_screen. To do so, you must be logged in to Facebook. If you do not have a Facebook or Instagram account, you can disable usage-based advertising from Meta on the website of the European Interactive Digital Advertising Alliance: http://www.youronlinechoices.com/de/praferenzmanagement/.

7) Newsletter

Newsletter data

If you would like to subscribe to the newsletter offered on the website, we require your email address as well as information that allows us to verify that you are the owner of the email address provided and that you agree to receive the newsletter. No further data is collected, or only on a voluntary basis.

We use newsletter service providers to handle the newsletter, which are described below.

Brevo
This website uses Brevo to send newsletters. The provider is Sendinblue GmbH, Köpenicker Straße 126, 10179 Berlin, Germany. Brevo is a service that can be used, among other things, to organize and analyze the sending of newsletters. The data you enter for the purpose of subscribing to the newsletter is stored on Sendinblue GmbH’s servers in Germany.

Data analysis by Brevo
With the help of Brevo, we are able to analyze our newsletter campaigns. For example, we can see whether a newsletter message has been opened and which links may have been clicked. This allows us, among other things, to determine which links are clicked particularly often.

We can also see whether certain predefined actions were carried out after opening/clicking (conversion rate). This enables us, for example, to see whether you made a purchase after clicking the newsletter.

Brevo also enables us to segment (“cluster”) newsletter recipients according to various categories. Newsletter recipients can be segmented, for example, by age, gender, or place of residence. This allows newsletters to be better tailored to the respective target groups.

If you do not want analysis by Brevo, you must unsubscribe from the newsletter. We provide a corresponding link for this purpose in every newsletter message.

For detailed information about Brevo’s features, please see: https://www.brevo.com/de/newsletter-software/.

Legal basis
Data processing is carried out on the basis of your consent (Art. 6(1)(a) GDPR). You can revoke this consent at any time. The legality of the data processing operations already carried out remains unaffected by the revocation.

Storage period
The data you have stored with us for the purpose of receiving the newsletter will be stored by us until you unsubscribe from the newsletter with us or the newsletter service provider and will be deleted from the newsletter distribution list after you unsubscribe. Data stored by us for other purposes remains unaffected.

After you unsubscribe from the newsletter distribution list, your email address may be stored by us or the newsletter service provider in a blacklist, if this is necessary to prevent future mailings. The data from the blacklist is used only for this purpose and is not merged with other data.

This serves both your interest and our interest in complying with legal requirements when sending newsletters (legitimate interest within the meaning of Art. 6(1)(f) GDPR). Storage in the blacklist is not time-limited. You can object to the storage if your interests outweigh our legitimate interest.

For more information, please refer to Brevo’s privacy policy at: https://www.brevo.com/de/datenschutz-uebersicht/ and https://www.brevo.com/de/legal/privacypolicy/.

Data processing

We have concluded a data processing agreement (DPA) for the use of the service mentioned above. This is a contract required under data protection law that ensures the service processes the personal data of our website visitors only in accordance with our instructions and in compliance with the GDPR.

8) Plugins and tools

YouTube with enhanced privacy

This website embeds videos from YouTube. The operator of the website is Google Ireland Limited (“Google”), Gordon House, Barrow Street, Dublin 4, Ireland.

When you visit one of our pages on which YouTube is embedded, a connection to YouTube’s servers is established. The YouTube server is informed which of our pages you have visited.

We use YouTube in enhanced privacy mode. According to YouTube, videos played in enhanced privacy mode are not used to personalize browsing on YouTube. Ads displayed in enhanced privacy mode are also not personalized. No cookies are set in enhanced privacy mode. Details on enhanced privacy mode can be found here: https://support.google.com/youtube/answer/171780.

After activating a YouTube video, further data processing operations may be triggered over which we have no influence.

9) Audio and video conferences

Data processing

To communicate with our customers, we use, among other things, online conferencing tools. The specific tools we use are listed below. If you communicate with us via video or audio conference over the internet, your personal data will be collected and processed by us and by the provider of the respective conferencing tool. The conferencing tools collect all data that you provide/use to use the tools (email address and/or your phone number). The conferencing tools also process the duration of the conference, the start and end (time) of participation in the conference, the number of participants, and other “context information” related to the communication process (metadata).

In addition, the tool provider processes all technical data required to handle online communication. This includes, in particular, IP addresses, MAC addresses, device IDs, device type, operating system type and version, client version, camera type, microphone or speaker, and the type of connection. If content is exchanged, uploaded, or otherwise provided within the tool, this content is also stored on the servers of the tool providers. Such content includes, in particular, cloud recordings, chat/instant messages, voicemails, uploaded photos and videos, files, whiteboards, and other information shared while using the service.

Please note that we do not have full influence over the data processing operations of the tools used. Our options depend largely on the corporate policy of the respective provider.

For further information on data processing by the conferencing tools, please refer to the privacy policies of the tools used, which we have listed below this text.

Purpose and legal bases

The conferencing tools are used to communicate with prospective or existing contractual partners or to provide certain services to our customers (Art. 6(1)(b) GDPR). Furthermore, the use of the tools serves the general simplification and acceleration of communication with us or our company (legitimate interest within the meaning of Art. 6(1)(f) GDPR).

Where consent has been requested, the relevant tools are used on the basis of that consent; consent can be revoked at any time with effect for the future.

Storage period

The data collected directly by us via the video and conferencing tools will be deleted from our systems as soon as you request deletion, revoke your consent to storage, or the purpose for storing the data no longer applies. Stored cookies remain on your end device until you delete them. Mandatory statutory retention periods remain unaffected. We have no influence on the storage period of your data that is stored by the operators of the conferencing tools for their own purposes. For details, please contact the operators of the conferencing tools directly.

10) Our own services

Handling applicant data

We offer you the opportunity to apply to us (e.g., by email, post, or via an online application form). Below, we inform you about the scope, purpose, and use of the personal data collected from you as part of the application process. We assure you that the collection, processing, and use of your data is carried out in accordance with applicable data protection law and all other legal provisions, and that your data will be treated as strictly confidential.

Scope and purpose of data collection

If you submit an application to us, we process the personal data associated with it (e.g., contact and communication data, application documents, notes taken during interviews, etc.) insofar as this is necessary to decide on the establishment of an employment relationship. The legal basis for this is Section 26 BDSG under German law (initiation of an employment relationship), Art. 6(1) 1 lit. (b) GDPR (general pre-contractual measures) and—if you have given consent—Art. 6(1) 1 lit. (a) GDPR. Consent can be revoked at any time. Your personal data will be passed on within our company only to persons involved in processing your application. If the application is successful, the data you submitted will be stored in our data processing systems on the basis of Section 26 BDSG and Art. 6(1) 1 lit. (b) GDPR for the purpose of carrying out the employment relationship.

As part of the application process, we may also conduct online research about you. This primarily includes Google searches, LinkedIn, and Xing. The legal basis for this type of processing is our legitimate interest in obtaining an overall impression of publicly available information about you in accordance with Art. 6(1) 1 lit. (f) GDPR.

Data retention period

If we are unable to make you a job offer, you reject a job offer, or you withdraw your application, we reserve the right to retain the data you have provided on the basis of our legitimate interests (Art. 6(1)(f) GDPR) for up to 6 months after the end of the application process (rejection or withdrawal of the application). After that, the data will be deleted and the physical application documents destroyed.

Retention serves in particular as evidence in the event of a legal dispute. If it is apparent that the data will be required after the 6-month period has expired (e.g., due to an impending or pending legal dispute), deletion will only take place once the purpose for further retention no longer applies. Longer retention may also take place if you have given corresponding consent (Art. 6(1)(a) GDPR) or if statutory retention obligations prevent deletion.

Inclusion in the applicant pool

If we do not make you a job offer, there may be an option to include you in our applicant pool. If you are included, all documents and information from your application will be transferred to the applicant pool so that we can contact you if suitable vacancies arise. Inclusion in the applicant pool takes place exclusively on the basis of your explicit consent (Art. 6(1)(a) GDPR). Giving consent is voluntary and is not related to the ongoing application process. The data subject can revoke their consent at any time. In this case, the data will be irrevocably deleted from the applicant pool, provided there are no statutory reasons for retention. The data in the applicant pool will be irrevocably deleted no later than two years after consent is given.
